General Rental Conditions of B&B Vastgoed Amsterdam V.O.F.
These General Conditions apply to the rental agreement between B&B Vastgoed Amsterdam V.O.F. and the tenant. The agreement relates to the rent of an accommodation that, by its nature, is for a short term only. Pursuant to Article 7:232(2) of the Dutch Civil Code, Part 5, which includes the provisions on rent protection, therefore does not apply to the rental agreement.
Booking and down payment
Before the booking is confirmed, a down payment on the rent must be made. That down payment is a percentage of the total amount of the rent and therefore depends on the accommodation and on the duration of the stay.
The booking will not be confirmed until the down payment has been made. As soon as the down payment has been received, the booking confirmation will be sent by e-mail. The booking will be final the moment the down payment has been received.
The remaining rent, plus € 200 as a damage deposit, must be paid to B&B Vastgoed Amsterdam V.O.F. in cash immediately upon arrival. The damage deposit will be repaid upon departure, after B&B Vastgoed Amsterdam V.O.F has established that the rented property has not been damaged.
In the interest of a correct booking and to avoid any misunderstanding, the tenant undertakes after receipt of the booking confirmation to check that the details are correct and complete, and to report any incompleteness or incorrectness to the landlord within seven days of receipt of the booking confirmation. If no such report is filed within that period, the tenant will not have the right to invoke the incompleteness or incorrectness of the booking confirmation.
Cancellation and changes
The reservation costs will not be refunded in any circumstances.
The cancellation costs will be set off at the percentages stated below in the event of cancellation. The cancellation costs depend on the term of notification prior to the date of arrival:
notification less than 14 days before the date of arrival: 50% of the total amount;
notification less than 24 hours before the date of arrival or no show: 100% of the total amount.
Changes to the booking will be regarded as a new booking. If a change is made, cancellation costs will therefore be charged for the old booking.
In order to book another apartment, a new booking must first be made. If the number of nights is changed, no cancellation costs will be charged, if possible, if the stay is extended.
Cancellations and changes must be reported by e-mail or by fax. Cancellations or changes reported by telephone will not be handled.
The tenant will receive the booking confirmation directly by e-mail. That booking confirmation contains all the check-in details. If no information on the estimated time of arrival is available yet at the moment of booking, the tenant must provide that information no later than 48 hours before arrival. That will enable the check-in staff to welcome the tenant.
Check in/out between 8pm-8am is subject to a 30 euro surcharge, check in/out between 11pm-6am is subject to a 50 euro surcharge.
During the stay
The tenant will be expected to handle the accommodation and its fixtures and fittings with due care. Certain specific rules and agreements regarding the accommodation and the surrounding area must be respected at all times. The tenant will also be expected to stay in the accommodation in close harmony with the neighbours.
If any damage is caused or if any defects occur in the rented property or in the fixtures and fittings during the stay, the tenant must immediately inform B&B Vastgoed Amsterdam V.O.F. accordingly. The tenant will be liable for any unreported damage or defects inflicted on the rented property or on the fixtures and fittings during the stay. Complaints regarding defects that are filed after the stay will not be financially compensated in any circumstances.
The tenant must respect his or her neighbours. This means, among other things, that the tenant may not make any noise after 10 p.m. The tenant will be responsible during the stay for the conduct of all the guests staying in the rented property. If one of the guests does not act in a responsible and respectful manner, B&B Vastgoed Amsterdam V.O.F. will have the right to demand that that person and other guests leave the rented property, without being entitled to any form of compensation.
The rented property will have been cleaned before arrival. When the tenant leaves the rented property at the end of the stay, he or she will be responsible for returning possession of the rented property in a neat condition. If the rented property is not returned in a reasonable condition, B&B Vastgoed Amsterdam V.O.F. will have the right to charge extra cleaning costs.
Number of guests and pets
The tenant will inform B&B Vastgoed Amsterdam V.O.F. of the number of persons involved in the booking. The number of guests staying in the rented property may not exceed the number stated in the booking confirmation, unless otherwise agreed with B&B Vastgoed Amsterdam V.O.F.
Pets will not be permitted. If one of the above rules is violated, B&B Vastgoed Amsterdam V.O.F. will have the right to obligate the tenant to vacate the rented property. B&BVastgoed Amsterdam V.O.F. will in no event be obligated to pay any compensation.
If B&B Vastgoed Amsterdam V.O.F. cannot make the accommodation available to the tenant due to an event of force majeure, B&B Vastgoed Amsterdam V.O.F. will use its best endeavours to offer the tenant a suitable alternative of the same quality. An event of force majeure includes a double booking. If no agreement can be reached, B&BVastgoed Amsterdam V.O.F. will repay the amount already paid. B&B Vastgoed Amsterdam V.O.F. will in no event be liable for any loss that may arise from such an event of force majeure. In this context the tenant indemnifies B&B Vastgoed Amsterdam V.O.F. if it is held liable by third parties under the rental agreement.
Restrictions imposed by the authorities
If B&B Vastgoed Amsterdam V.O.F. is unable due to new or existing regulations imposed by the authorities to make the accommodation available to the tenant, that will also constitute an event of force majeure. The provisions set out under the heading Force majeure will in that case apply accordingly.
B&B Vastgoed Amsterdam V.O.F. will not be liable for any direct or indirect loss of the tenant as a result of the use of or accommodation in the rented property or any loss whatsoever, including but not limited to loss caused by damage, personal injuries, insurance and loss caused by fire and criminal activities, all of this without any limitation. In the event of notice of liability from third parties under the rental agreement, the tenant indemnifies B&B Vastgoed Amsterdam V.O.F.
Obvious errors and mistakes in the description or prices of the accommodation made available by B&B Vastgoed Amsterdam V.O.F. will not be binding on B&B Vastgoed Amsterdam V.O.F.
B&B Vastgoed Amsterdam V.O.F. will in no event be required to pay a higher amount in damages than:
the value of the booking; or
the amount paid to B&B Vastgoed Amsterdam V.O.F. by its insurer in respect of the loss.
The above provisions will not apply insofar as the loss is due to intent of gross negligence on the part of B&B Vastgoed Amsterdam V.O.F.
The tenant and the persons who accompany it will be jointly liable for all the loss incurred or yet to be incurred by B&B Vastgoed Amsterdam V.O.F. and/or any third party as a direct or indirect result of breach of contract and/or a wrongful act related to the rental agreement.
In the event of legal proceedings of any form whatsoever regarding the booking of accommodation at B&B Vastgoed Amsterdam V.O.F., the Dutch court will have exclusive jurisdiction. Dutch law will apply at all times. The same applies to any legal actions between the tenant and B&B Vastgoed Amsterdam V.O.F.
All descriptions and information regarding the rented property have been provided by B&B Vastgoed Amsterdam V.O.F. Although B&B Vastgoed Amsterdam V.O.F. uses its best endeavours to guarantee the correctness of the description and verifies all the details where possible, B&B Vastgoed Amsterdam V.O.F. will in no event be liable for any errors or failure to state details.
B&B Vastgoed Amsterdam V.O.F. reserves the right at any time to change information on its website, including rates, descriptions and photographs.
